Młotkowice, 8 October 1947. At 2:00 PM, with the participation of a reporter, in the presence of witness Stefan Bancerz, a Citizens’ Militia officer, whom I advised of the requirement to certify with his signature that the report reflected the actual course of the procedure, I, Mieczysław Stecharz, chief of the Citizens’ Militia station in Ruda Maleniecka, interviewed the person named below as a witness. Having been advised of the significance of the oath [and of] the right [to] refuse testimony for reasons listed in Article 104 of the Code of Criminal Procedure, [as well as of] the liability for making false declarations in accordance with Article 107 of the Code of Criminal Procedure, the witness was sworn [and testified as follows:]

Before noon on 31 October 1941, when I was in my yard throwing [illegible] off the cart, I suddenly heard that there were gendarmes in the village of Młotkowice, Ruda Maleniecka commune. At the same time I heard a shot, so I ran behind my barn, where I noticed Wincenty Sobań, a resident of the village of Młotkowice, Ruda Maleniecka commune, who was walking with his hands up from the field to the village, where one of the gendarmes [then] fired a shot in front of the barn, and Wincenty Sobań fell to the ground. I don’t know the names of the gendarmes who shot. I don’t know whose orders they were following, either, because I was not very much acquainted with these matters. Wincenty Sobań was buried by his parents in the cemetery in Lipa.
