On 13 December 1947 in Nowy Sącz, the Prosecutor’s Office of the District Court in Nowy Sącz with its seat in Nowy Sącz, in the person of Prosecutor K. Gołębiewski (MA), with the participation of reporter Helena Bilik, pursuant to Article 20 of the provisions introducing the Code of Criminal Procedure, interviewed the person mentioned below as an unsworn witness. Having been advised of the criminal liability for making false declarations and of the significance of the oath, the witness testified as follows:

As a former prisoner of the Auschwitz camp and having followed the course of the trial in Kraków against oppressors from Auschwitz, I declare that certain circumstances relevant for the case have not come to light yet. Therefore, I would like to testify and provide certain facts that I witnessed.
I stayed in the Auschwitz camp from 20 June 1940 to 10 October 1943, when I was sent to the Hamburg-Neuengamme camp. In the autumn of 1940 when a second transport of prisoners from Warsaw arrived, I saw Fritzsch’s deputy nicknamed “Laluś” [dandy] distribute canes made of fresh wicker among the kapos, whom he ordered to use them to beat prisoners. The kapos beat the prisoners with the canes, as a result of which many people were killed.
In 1941, a number of prisoners were thrown into the bunker as a punishment for certain camp insubordinations. An engineer whom I knew, but whose name I cannot recall, was among the prisoners sentenced to two days in the bunker for writing a secret message. It turned out that about 40 people were squeezed into a bunker intended for 10 people, as a result of which only three of them were alive the following morning.
